ยินดีต้อนรับสู่ Quoteshelf by Dearbook ("บริการ") ซึ่งเป็นแพลตฟอร์มที่นำเสนอประโยคจากหนังสือ (book quotes) ในรูปแบบ visual cards บริหารและให้บริการโดย Dearbook

การเข้าใช้งานบริการนี้ ไม่ว่าจะในฐานะผู้เยี่ยมชม ผู้ใช้ฟรี หรือสมาชิกแบบเสียค่าใช้จ่าย ถือว่าท่านได้อ่าน เข้าใจ และยอมรับ เงื่อนไขฉบับนี้ รวมถึงนโยบายลิขสิทธิ์ (Copyright Policy) และนโยบายความเป็นส่วนตัว (Privacy Policy) แล้ว หากท่านไม่ยอมรับเงื่อนไขใด ๆ โปรดงดใช้งานบริการ

• ผู้ใช้ต้องมีอายุ อย่างน้อย 13 ปีบริบูรณ์ จึงจะสมัครบัญชีได้ หากท่านอายุต่ำกว่า 20 ปีบริบูรณ์ การสมัครและใช้งานต้องได้รับความยินยอมจากผู้ปกครองตามกฎหมาย
• ผู้ใช้ต้องให้ข้อมูล ที่ถูกต้องและเป็นปัจจุบัน ขณะสมัคร เช่น อีเมล และข้อมูลโปรไฟล์
• ผู้ใช้รับผิดชอบในการรักษาความปลอดภัยของบัญชี (อีเมลและการเข้าถึง) และยอมรับว่ากิจกรรมทั้งหมดที่เกิดขึ้นภายใต้บัญชีของท่านถือว่าท่านเป็นผู้กระทำ
• หนึ่งบุคคล สามารถสมัครบัญชีได้เพียง หนึ่งบัญชีหลัก ห้ามสร้างบัญชีปลอมหรือบัญชีสำหรับการละเมิด

บริการแบ่งเป็น 2 ระดับ ได้แก่ Free และ Pro รายละเอียดของแต่ละแพ็กเกจดูได้ที่หน้า /pricing

• ค่าสมาชิก Pro เรียกเก็บล่วงหน้า แบบรายเดือนหรือรายปี ตามที่ผู้ใช้เลือก
• การสมัคร Pro ต่ออายุอัตโนมัติ เมื่อสิ้นสุดรอบบิล เว้นแต่ผู้ใช้จะยกเลิกก่อนวันต่ออายุ
• สมาชิกใหม่จะได้รับ ทดลองใช้ฟรี 7 วันแรก (ครบทุกฟีเจอร์ Pro) ก่อนเริ่มเก็บเงินอัตโนมัติ · ผู้ใช้ต้องใส่ข้อมูลบัตรเครดิตตอนสมัครเพื่อยืนยันตัวตน · หากยกเลิกระหว่าง trial จะใช้ Pro ต่อได้จนสิ้นสุด 7 วัน แล้วกลับเป็น Free อัตโนมัติโดยไม่ถูกตัดเงิน
• ราคา รวมภาษีที่เกี่ยวข้อง ตามที่กฎหมายไทยกำหนด (ถ้ามี)
• การชำระเงินดำเนินการผ่านผู้ให้บริการรับชำระเงินที่ได้รับใบอนุญาต (เช่น Stripe) Quoteshelf ไม่จัดเก็บข้อมูลบัตรเครดิตหรือข้อมูลทางการเงินไว้บน server ของเรา
• ผู้ใช้ต้องอายุ 18 ปีบริบูรณ์ขึ้นไป จึงจะสมัคร Pro ได้ด้วยตนเอง หากต่ำกว่านั้นต้องได้รับความยินยอมจากผู้ปกครอง

• ค่าสมาชิก Pro ไม่สามารถขอคืนได้ หลังจากชำระเงินสำเร็จ ไม่ว่าผู้ใช้จะใช้งานหรือไม่ก็ตาม
• ผู้ใช้สามารถยกเลิกการต่ออายุได้ตลอดเวลา ผ่านหน้า /settings และจะยังคงใช้งาน Pro ได้จนถึงสิ้นสุดรอบบิลปัจจุบัน
• ในกรณีที่ Quoteshelf จะปิดให้บริการแบบถาวร เราจะแจ้งให้ทราบล่วงหน้าผ่านอีเมลและประกาศบนเว็บไซต์ตามสมควร (โดยทั่วไปอย่างน้อย 30 วัน) และหากการปิดบริการเกิดขึ้นระหว่างรอบสมาชิกที่ท่านชำระแล้ว — รวมถึงกรณีที่ต้องปิดทันทีหรือฉุกเฉิน — เราจะคืนเงินตามสัดส่วนสำหรับช่วงเวลาที่ยังไม่ได้ใช้งานในรอบบิลนั้น
• ในกรณีที่เกิดข้อผิดพลาดในการเรียกเก็บเงินซ้ำซ้อน (duplicate charge) โปรดติดต่อเราภายใน 30 วันเพื่อขอแก้ไข

ผู้ใช้ตกลงว่าจะไม่ใช้บริการเพื่อ:

• อัปโหลด quote หรือเนื้อหาที่ละเมิดลิขสิทธิ์ ของบุคคลที่สาม (ดูรายละเอียดเพิ่มเติมที่ Copyright Policy)
• เผยแพร่เนื้อหาที่ผิดกฎหมายไทย ขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดี หมิ่นประมาท ลามกอนาจาร ยุยงให้เกิดความรุนแรง หรือเลือกปฏิบัติ
• พยายามเข้าถึงระบบโดยไม่ได้รับอนุญาต ทำ reverse engineering, เจาะระบบ, scraping จำนวนมาก หรือใช้บอตที่ละเมิดข้อจำกัด API
• ขายต่อ ให้เช่า หรือใช้บริการเชิงพาณิชย์ในนามของบุคคลที่สามโดยไม่ได้รับอนุญาต เป็นลายลักษณ์อักษร
• ปลอมตัวเป็นบุคคลอื่น หรือสร้างเนื้อหาที่ทำให้เข้าใจผิดเรื่องที่มา

การละเมิดข้อใดข้อหนึ่ง อาจส่งผลให้บัญชีของท่านถูกระงับหรือยุติทันที โดยไม่ต้องแจ้งล่วงหน้า และไม่มีการคืนเงินค่าสมาชิก

• ส่วนติดต่อผู้ใช้, โค้ด, การออกแบบ, แบรนด์ Quoteshelf และ Dearbook, และเนื้อหาที่ทีมงานคัดสรร (curation) เป็น ทรัพย์สินของ Dearbook และได้รับการคุ้มครองตามกฎหมายลิขสิทธิ์ เครื่องหมายการค้า และกฎหมายอื่นที่เกี่ยวข้อง
• เนื้อหา quote ต้นฉบับยังคงเป็นลิขสิทธิ์ของผู้แต่งและสำนักพิมพ์ต้นฉบับ Quoteshelf อ้างอิงภายใต้กรอบ Fair Use (ดู Copyright Policy)
• เนื้อหาที่ผู้ใช้ Pro สร้างขึ้น (เช่น card ที่ผู้ใช้ทำเอง) ลิขสิทธิ์ยังคงเป็นของผู้ใช้ แต่ผู้ใช้ให้สิทธิ์ Quoteshelf ใช้สำหรับการแสดงผล จัดเก็บ ทำ thumbnail และเผยแพร่บนแพลตฟอร์มตามวัตถุประสงค์ของบริการ

• ผู้ใช้สามารถลบบัญชีของตนเองได้ตลอดเวลาผ่านหน้า /settings
• Quoteshelf อาจระงับหรือยุติบัญชีหาก: พบการละเมิดเงื่อนไข, ได้รับ takedown notice ที่มีมูล, หรือมีเหตุอันสมควรเพื่อปกป้องผู้ใช้รายอื่นหรือบริการโดยรวม
• เมื่อบัญชีถูกยุติ เนื้อหาที่ผู้ใช้สร้างขึ้นและข้อมูลส่วนบุคคล จะถูกลบหรือทำให้ไม่สามารถระบุตัวตนได้ภายใน 30 วัน ยกเว้นในกรณีที่กฎหมายกำหนดให้เก็บรักษา

• บริการ Quoteshelf ให้บริการตามสภาพ ("AS IS") และตามที่มี ("AS AVAILABLE") เราไม่รับประกันว่าบริการจะไม่มีข้อผิดพลาด ไม่หยุดชะงัก หรือเหมาะสมกับวัตถุประสงค์เฉพาะของผู้ใช้
• เราไม่รับประกัน uptime หรือความพร้อมใช้งานของบริการ ณ เวลาใดเวลาหนึ่ง แม้ว่าเราจะพยายามอย่างดีที่สุดในการให้บริการอย่างต่อเนื่อง
• ในกรณีที่กฎหมายอนุญาต ความรับผิดสูงสุดของ Quoteshelf ต่อผู้ใช้แต่ละราย ไม่เกินจำนวนเงิน ที่ผู้ใช้ได้ชำระให้แก่ Quoteshelf ในรอบ 12 เดือนที่ผ่านมา
• เราไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายต่อเนื่อง การสูญเสียกำไร หรือการสูญเสียโอกาสทางธุรกิจ

Quoteshelf อาจปรับปรุงเงื่อนไขนี้เป็นครั้งคราว เมื่อมีการเปลี่ยนแปลงในสาระสำคัญ เราจะแจ้งให้ทราบล่วงหน้าผ่านอีเมลและประกาศบนเว็บไซต์ อย่างน้อย 14 วัน ก่อนการเปลี่ยนแปลงมีผล หากผู้ใช้ยังคงใช้งานบริการต่อหลังจากนั้น จะถือว่าได้ยอมรับเงื่อนไขฉบับปรับปรุงแล้ว

เงื่อนไขฉบับนี้อยู่ภายใต้ กฎหมายไทย ในกรณีที่เกิดข้อพิพาท คู่สัญญาตกลงที่จะ พยายามเจรจากันก่อนเป็นอันดับแรก หากการเจรจาไม่สำเร็จ ให้ ศาลที่กรุงเทพมหานคร เป็นศาลที่มีเขตอำนาจในการพิจารณาคดี

Welcome to Quoteshelf by Dearbook (the "Service") — a platform that presents book quotes as visual cards, operated by Dearbook.

By accessing the Service — whether as a visitor, free user, or paid subscriber — you confirm that you have read, understood, and accepted these Terms, together with our Copyright Policy and Privacy Policy. If you do not accept any part of these Terms, please refrain from using the Service.

• You must be at least 13 years old to create an account. If you are under 20 years of age (Thai majority age), registration and use require parental or legal-guardian consent.
• You agree to provide accurate, current information when registering (email, profile details).
• You are responsible for maintaining the security of your account (email access, credentials). All activity occurring under your account is deemed performed by you.
• Each person may hold one primary account. Fake or abusive accounts are prohibited.

The Service is offered in two tiers — Free and Pro. Details are available at /pricing.

• Pro subscriptions are billed in advance, monthly or annually, at the user's selection.
• Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.
• First-time subscribers receive a 7-day free trial with full Pro access before automatic billing begins. Credit-card details are required at signup for identity verification. Cancelling during the trial allows continued Pro use until day 7, after which the account reverts to Free automatically and no charge is made.
• Prices include applicable Thai taxes where required by law.
• Payments are processed via licensed payment providers (e.g. Stripe). Quoteshelf does not store credit-card or financial data on its servers.
• You must be 18 years or older to subscribe to Pro directly; otherwise, parental consent is required.

• Pro fees are non-refundable once a payment is completed, regardless of usage during the period.
• You may cancel auto-renewal at any time via /settings and will retain Pro access until the end of the current billing cycle.
• If Quoteshelf will permanently discontinue the Service, we will give reasonable advance notice by email and a website notice (generally at least 30 days). If the discontinuation occurs during a billing period you have already paid for — including an immediate or emergency closure — we will issue a pro-rated refund for the unused portion of that billing period.
• For duplicate or erroneous charges, contact us within 30 days for correction.

You agree not to use the Service to:

• Upload quotes or content that infringes third-party copyright (see Copyright Policy).
• Distribute content that violates Thai law, public order, or morals; defamatory, obscene, inciting violence, or discriminatory content is prohibited.
• Attempt unauthorised access, reverse-engineer the platform, perform mass scraping, or use bots that violate API limits.
• Resell, sublicense, or commercially exploit the Service on behalf of third parties without our written permission.
• Impersonate others or create content that misrepresents its source.

Violations may result in immediate suspension or termination of your account without prior notice and without refund.

• The user interface, code, design, Quoteshelf and Dearbook brand identities, and our curated content are the property of Dearbook, protected under copyright, trademark, and other applicable laws.
• Original quotes remain the copyright of their respective authors and publishers. Quoteshelf reproduces them under the Fair Use framework (see Copyright Policy).
• Content created by Pro users (user-generated cards) remains your copyright. By submitting it, you grant Quoteshelf a licence to host, display, generate thumbnails, and distribute such content on the platform as needed to operate the Service.

• You may delete your account at any time via /settings.
• Quoteshelf may suspend or terminate accounts for: violations of these Terms, valid takedown requests, or reasonable cause to protect other users or the Service.
• Upon termination, user-generated content and personal data will be deleted or anonymised within 30 days, except where retention is required by law.

• The Service is provided "AS IS" and "AS AVAILABLE". We do not warrant that the Service will be error-free, uninterrupted, or fit for a particular user's purpose.
• We do not guarantee uptime or availability, although we make reasonable efforts to maintain continuous service.
• To the extent permitted by law, Quoteshelf's aggregate liability to any user shall not exceed the amount paid by that user to Quoteshelf in the preceding 12 months.
• We are not liable for indirect, consequential, lost-profit, or business-opportunity damages.

Quoteshelf may update these Terms from time to time. For material changes, we will provide notice via email and on the website at least 14 days before the change takes effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Thailand. In the event of a dispute, the parties shall first attempt good-faith negotiation. Failing that, the courts of Bangkok, Thailand shall have exclusive jurisdiction.
